Please read these Terms of Service ("Terms") carefully before using GymBot. By using GymBot, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

GymBot is an AI-powered fitness coaching service delivered via WhatsApp. The service provides personalized workout programs, meal plans, exercise videos, and nutritional guidance based on the information you provide.

2. Eligibility

You must be at least 16 years old to use GymBot.
You must have a valid WhatsApp account.
You agree to provide accurate information during onboarding and keep it updated.

3. Subscription and Payment

Free trial: New users receive 7 days of free access. No payment required to start.
Subscription: After the trial, continued access requires a paid subscription at €2.99/month.
Billing: Subscriptions are billed monthly. Payment is processed by Stripe.
Cancellation: You may cancel at any time. Access continues until the end of the current billing period.
Refunds: We offer a 7-day money-back guarantee for first-time subscribers. Contact us within 7 days of your first charge.
Price changes: We will notify you at least 30 days before any price change.

4. Health and Medical Disclaimer

IMPORTANT: GymBot provides general fitness and nutritional information for educational purposes only. GymBot is NOT a medical service and does NOT provide medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before starting any exercise or diet program.
Do not use GymBot if you have medical conditions that may be affected by exercise or dietary changes.
Stop exercising and seek medical attention if you experience pain, dizziness, or shortness of breath.
Calorie and nutrient calculations are estimates and may not be accurate for your specific situation.

5. Acceptable Use

You agree not to:

Share your account or subscription with others.
Attempt to reverse-engineer or copy our AI programs or workout content.
Use the service for commercial purposes without written permission.
Submit false health information that could harm yourself.
Abuse the support system or send inappropriate messages.

6. Intellectual Property

All content provided by GymBot — including workout programs, exercise descriptions, meal plans, and recipes — is owned by GymBot or its licensors. You may not reproduce, distribute, or create derivative works without express written permission.

You retain ownership of the personal data you provide. By using GymBot, you grant us a license to use this data to provide and improve the service.

7. Limitation of Liability

To the maximum extent permitted by law, GymBot shall not be liable for:

Any physical injury or health consequences resulting from following workout or nutrition programs.
Indirect, incidental, or consequential damages.
Loss of data, profits, or business opportunities.
Service interruptions or WhatsApp platform issues beyond our control.

Our total liability to you for any claim shall not exceed the amount you paid in the 3 months preceding the claim.

8. Service Availability

We aim to provide 99%+ uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We are not responsible for WhatsApp platform outages.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us via WhatsApp. Upon termination, your data will be deleted within 30 days, subject to legal retention requirements.

10. Governing Law

These Terms are governed by the laws of Portugal and the European Union. Any disputes shall be resolved in the courts of Portugal. EU consumers retain their statutory rights regardless of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you via WhatsApp at least 14 days before significant changes take effect. Continued use of GymBot after the effective date constitutes acceptance of the updated Terms.
